I'm scared to file for workers comp?
I've been working as a cook at the same restaurant off and on for the last several years. For the last several months I've been working as the grill cook which involves repeated lifting of 6 pound steak weights with squeeze tongs and repeated lifting of heavy fryer baskets. I have all of the symptoms of carpal tunnel in my dominant hand.
The thing is, my manager keeps trying to get me to get private insurance and get it looked at. He has strongly dissuaded me from trying to get it fixed through WC. One other woman cook had to have surgery in both wrists and she had to wage a major battle to get it covered.
I have no insurance now so I'm scared I'll file WC, lose the case, and then have it on record as a pre-existing condition so that no other insurance company will ever pay for it. I play tennis, rock climb, and do al ot of typing on the computer. I'm scared they'll say these activities caused it, not cooking, even though only one hand hurts. Ideas anyone?
If you believe the symptoms are related to work, you need to take steps to be sure it has been properly reported, etc. Most states have a statute of limitations in which to file for WC.
In NY, you have 2 years from the date of injury (or date you first knew it was related in an occupational disease situation as you describe) to file a written claim for benefits. However, you do need to give your employer written notice of your claim ASAP.
If you are in NY, you can get a C-3 claim form from the Workers' compensation website at www.wcb.state.ny.us and then click on the "common forms" button.
In NY, you need to have a doctor give a history of the injury, a diagnosis and a statement of whether the injury is related to your work duties.
Sometimes the bills are apportioned between work related and non-work related if the symptoms are caused by an unrelated work event.
In NY, the current rate of payment while off due to the injury is 2/3 of your average weekly wage if you are 100% disabled. The maximum rate for injuries sustained prior to 7/1/07 is $400.00 per week.
WC doesn't necessarily cause a hardship on employers, and not all rates go up for the employers simply because a claim was filed, it really depends on their policy of insurance and the number of claims and amounts expended on the claims. BUT THIS SHOULD NOT CONCERN YOU. Your main goal is to get the treatment that you need so that you can continue to be productive and work for a living.
